Freelance journalist Juan Alberto Vazquez said in an interview in Spanish on Tuesday that Neely – described online as a 30-year-old Michael Jackson impersonator – “started screaming in an aggressive manner.” According to Vazquez, Neely commented that he “didn’t have anything to eat or drink, was tired, and didn’t care if he was going to jail.”
“He starts giving a speech,” Vazquez said. “He started screaming aggressively,” Vazquez told the Post. “He said he had nothing to eat, he hadn’t drunk, he was tired and he didn’t care if he went to jail. He started yelling all those things, took off his jacket, a black jacket he had, and threw it on the ground.”

The unnamed straphanger, who sources say is a Marine veteran, then moved behind Neely before choking him to the ground.
Vazquez says the man held Neely in a chokehold for more than 15 minutes, the Post reports.
Neely, who had a history of mental health issues and was living on the street at the time of the incident, quickly lost consciousness in the stranglehold.
The grip was so tight that rescue workers were unable to revive him, police and law enforcement sources said.
The man who choked Neely was taken into custody before being later released without charge New York Post.

No charges as of Wednesday, man questioned but eventually released
Sources told the Post the investigation is ongoing and authorities are awaiting the results of the autopsy before deciding whether to press charges against the younger man.
Vasquez, who witnessed the incident, says the straphanger held Neely in place when someone replied, “He’s not squeezing anymore.”
“None of us who were there thought he was in any danger of death,” Vasquez said. “We thought he just passed out or was out of breath.”
